PROPOSED ACTION: The Association seeks to retain the authority to regulate public roadways within the community pursuant to A.R.S. ? 33-1818 (B)(1). If approved, the Association will maintain its authority to regulate the publicly dedicated streets within the community pursuant to its governing documents, including the CC&Rs. Failure to obtain member approval will result in the Association having no control or authority over vehicles parked within the streets of the community. The purpose of the Meeting will be for Members to vote and decide whether the Travis Park Homeowners Association (Association) will retain the authority to regulate public roadways within the community. A.R.S. ? 33-1818 (B)(1) provides that ?Not later than June 30, 2025, the planned community shall call a meeting of the membership on the question of whether to continue to regulate public roadways.? The Association consists of streets that were dedicated to the public, pursuant to the Final Plat for Travis Park. Should the Association fail to obtain approval to continue to regulate the publicly dedicated roadways, owners and guests will be able to park any vehicles on the streets, regardless of prohibitions in the CC&Rs, without any recourse from the Association. This includes trailers, boats, RV?s or any other vehicle that may be prohibited by the CC&Rs or any other of the Association?s governing documents. In order to retain authority to regulate the public roadways, the Association must obtain approval of Owners representing a majority of votes of those voting at this meeting either in person or via absentee ballot or electronic voting. Quorum for this meeting shall be the presence, either in person or via absentee ballot, of members entitled to cast ten percent (10%) of the votes of the Association. See Article II, Section 8 of the Bylaws.
