Your participation is essential to help determine whether Wynstone Crossings Homeowners Association, Inc. (HOA) will retain authority over these matters or if parking enforcement will transition to the jurisdiction of the City of Mesa. Overview of A.R.S. ? 33-1818 Under Arizona Revised Statutes (A.R.S.) ? 33-1818, HOAs are granted authority to regulate public roadways, but this authority is set to expire on June 30, 2025, unless renewed through a community vote. If a quorum is met and a majority of members vote to continue this regulation, the HOA will retain its authority. This decision must then be recorded with the county. If the vote fails or does not occur, the HOA's ability to enforce parking rules will cease, and all future parking-related matters will need to be handled by the City. Please note that this statute does not impact private or one-way streets. Importance of Your Vote A meeting of the members is scheduled for June 26, 2025, to decide whether the HOA should continue enforcing parking regulations on public roads. This decision will have significant implications for our community: ? If the Vote Succeeds: The HOA will retain its authority to regulate parking on public roads, ensuring consistent enforcement of our community?s standards. ? If the Vote Fails: The HOA will lose jurisdiction over public roadways, and any parking-related complaints will need to be directed to the City for resolution. This means the HOA will no longer be able to address or enforce parking issues on these roads. Accordingly, owners would then be able to park any vehicle on the road, such as boats, trailers, commercial vehicles, large trucks, etc. with no recourse for the Association to take against those owners. The City may enforce any applicable local ordinances, but it is unclear what will be the extent of the City?s enforcement.
